Skype confused with Sky?

I seem to remember Victoria Beckham trying to copyright the word Posh and objecting to the followers of Portsmouth (of was it Peterborough?) football club using that word which was the nick name they had had for years.
The connection between VB and the concept 'posh' is debatable.
The word 'sky' can't belong to a company, it is the word for what is up above us.

Why did it post before I was finished? They get so defensive of their name that they strike where it is not being attacked at all.

I have no problem differentiating.

Did you read recently that the Copthorne hotel chain, named after the 1,000 year old village of the same name, tried to stop the Copthorne Resudents' Association using the name as the hotel chain said it was a copyright! What a cheek.

I think they're looking at it cross eyed. The two examples in the link could not be confused.

The General Court of the European Union have said that Skype's logo is too similar to Sky's. Skype were trying to register their logo and brand to prevent anyone else calling their product Skype.

The court would not register it, saying that "Conceptually, the figurative element conveys no concept, except perhaps that of a cloud."

"[That] would further increase the likelihood of the element 'Sky' being recognised within the word element 'Skype', for clouds are to be found 'in the sky' and thus may readily be associated with the word 'sky'."

I have never had any problem with it, I have never confused it with the broadcaster. Clouds are a feature of many brand logos - a blue background is found in the sky too, and the concept of an internet phone call being up in the sky is OK with me.

Do you think they are being too picky, or do you think that Sky are really in danger from Skype?
