Oh for goodness sake! I understand Sturgeon on the advice of her solicitor gave a written statement to the police setting out her position. Specifically saying "no comment" to any police questions is a legal right. In the eyes of the law it is for the police to find evidence sufficient to prosecute NOT for defendants to prove innocence.
On arrival at a police station to represent Sturgeon, her solictor would have had, as always a "disclosure" meeting with the police officer who then conducted the interview. In that disclosure meeting the police officer would have outlined the line of enquiry, actual or potential charge, and any evidence the police had in their possession relating to any criminal embezzlement criminality.
Evidence can typically range from bank account, CCTV, texts, emails, end of year budget reports, etc etc of alleged offence.
Cases do not go to trial unless there is a likely prospect of success, as supported by the evidence gathered in the police investigation.
The solicitor then reflects of the strength of the police evidence and then has a private consultation with their client before police interview. If the evidence is weak in respect of your client- a solicitor would often advise their client to provide a written statement along the lines of "I N Sturgeon, have no knowledge of any embezzled funds and have not been party to any embezzlement. I also have no knowledge of the individual/s who may be involved in the embezzlement of SNP funds. I fully cooperate in the police investigation and am willing to co-operate further as the investigation continues. I sign this statement as true to the best of my knowledge". They then hand the statemnt to the police interviewer at the start of the interview on record. The legal advice in such circumstance is to say 'no comment' to any particular, further questions and the solicitor may also say something along the lines- "all the knowledge my Client has about this matter is included in her written statement. I also understand that Sturgeon sent a further, detailed written statement to the police after her interview - well that's my understanding what she said on LK show this morning.
Sturgeon did, in fact, fully and appropriately co-operate with Police Scotland.
